Agency Worker Regulations 2010 - What does this mean for our Candidates?

1 October 2011 is the date the new Agency Workers Regulations 2010 (AWR) came into force. The final guidelines for AWR were published by the Department for Business Innovation and Skills in May 2011 and can be downloaded online.

What is AWR?

AWR is being introduced to comply with the European Union’s agency workers directive, which was agreed back in 2008. Its intention is to protect vulnerable temporary workers from less favorable treatment and working conditions.

All UK organisations are expected to provide a temporary agency worker with basic day one entitlements and after a 12 week qualifying period,  they will receive equal treatment and entitlements comparable to a permanent worker. These Include: full use of on-site facilities, (“collective facilities”), basic working and employment conditions, e.g. pay, hours of work, annual leave entitlement and maternity entitlements.

DAY ONE ENTITLEMENTS WEEK 12 ENTITLEMENTS
Day one rights: Access to “collective facilities” – e.g. canteen, creche, transport, internal vacancies. Post 12 weeks rights: Pay and annual leave equal to the comparator of the hirer.

What action are we taking?

CCS Recruitment are taking steps to ensure we are compliant with regards to the Agency Worker Regulations 2010 in order to protect out Client, agency workers and own position. From the start of an assignment information is being posted/emailed out to the clients. All we ask is that clients return the information within the 12 week qualifying period so that we are able to ascertain whether a Candidate is being treated less favorably or not.

We have in place a grievance procedure should a temporary agency worker wish to make a complaint, where they feel that they are treated less favorably.
